What you should know about altering child support in Arizona

Child support orders are to ensure children receive adequate financial support from both parents. However, life circumstances can change, and sometimes these orders need a modification. 

Understanding the process of changing a child support order is important for parents who find themselves in new financial situations or facing altered family dynamics. 

Can you modify a child support order?

Yes, you can request a modification of your child support order in Arizona, but only under certain conditions. The courts will consider modifying an existing order if there has been a significant and continuing change in circumstances. This change must result in a potential increase or decrease of at least 15% or $50 per month in the current support amount, whichever is less. 

Some examples of significant changes include:

  • A substantial increase or decrease in income for either parent
  • Job loss or a change in employment status
  • The development of a long-term illness or disability
  • A significant change in the amount of parenting time

Note that the courts will not consider minor or temporary changes as grounds for modification. The change must be substantial and likely to continue for an extended period.

How do you request a modification?

To request a modification, either file a petition with the court or work through the Arizona Division of Child Support Services (DCSS). If you choose to go through DCSS, you’ll need to complete a modification packet and provide supporting documents, such as proof of income and expenses. DCSS will then review information from both parents and determine if a modification is appropriate.

If you decide to file directly with the court, you’ll need to submit a petition for modification and attend a hearing. During this process, both parents have the opportunity to present their case for why the support amount should or should not change.

When does the new support amount take effect?

If the court approves a modification request, the new child support amount typically goes into effect on the first day of the month following the court hearing. Be aware that modifications are not retroactive in Arizona. Any changes to the support amount only apply going forward from the date of the new order. The parent paying support must continue to pay the current amount until the new order is in place.
